The Hub by Pack Animals Liability Waiver
Last updated Oct. 12th, 2025
Welcome to The Hub by Pack Animals! The below terms are binding between you and Pack Animals, Inc. (“Pack Animals”, “we”, “us”). By executing this waiver, you understand that the following terms (the “Waiver”) govern all activities at any The Hub location, including participation, visitation, membership, training, daycare, or any other service involving your dog, whether you are present or your dog is left in our care (collectively, “Activity”). In consideration for your participation in the Activity and the services to be provided by us, you hereby agree to all the terms and conditions set forth in this Waiver.
1. Assumption of Risk
You are aware and understand that interacting with dogs at The Hub may be potentially dangerous and could involve risks including, but not limited to, bites, scratches, jumping, collisions, allergies, illness, serious injury, disability, death, or property damage (collectively, “Injuries”) for you, your family members, dependents, or your dogs. You acknowledge that any Injuries may result from or be compounded by other factors such as lack of immediate emergency response. You further acknowledge and accept that dogs may be injured, become ill, or experience stress, anxiety, or death as a result of interaction with other dogs, environmental exposure, or other causes inherent to daycare, training, or boarding environments. You voluntarily assume all risks of loss, damage, or injury to person, pet, or property, whether known or unknown, arising from or related to your participation in the Activity.
2. Care, Custody, and Control
If you leave your dog in the care of Pack Animals for daycare or other services during which you are not present, you acknowledge that Pack Animals assumes temporary custody of your dog as a bailee. Pack Animals will exercise reasonable care in the supervision and handling of your dog; however, you understand and agree that Pack Animals is not an insurer of your dog’s safety, health, or welfare, and shall not be liable for any injury, illness, escape, or death of your dog that may occur despite such reasonable care. You acknowledge that you have been informed of and accept the inherent risks associated with group play, socialization, and housing environments.
3. Compliance with Policies
You agree and acknowledge that you have read and understand all rules and conditions applicable to the Activity and agree to comply with all instructions, whether provided verbally, in writing, or through our website, which is incorporated herein by reference. Participation is at the sole discretion of Pack Animals.
4. Waiver and Release
You hereby expressly waive and release any and all claims, now known or hereafter known, against Pack Animals and its officers, directors, managers, employees, agents, affiliates, shareholders, successors, and assigns (collectively, “Releasees”), arising out of or attributable to the Activity, whether arising from the ordinary negligence of Pack Animals or any Releasees or otherwise. You covenant not to make or bring any such claim against Pack Animals or any other Releasee, and forever release and discharge all Releasees from liability under such claims. This waiver and release does not extend to claims for gross negligence, willful misconduct, or other liabilities that cannot legally be released under California law.
5. Medical Treatment
You consent to receive medical treatment deemed necessary if you are injured or require medical attention during your participation in the Activity, and you are solely responsible for related costs. You hereby release Pack Animals from any claim based on such treatment or other medical services.
If your dog becomes ill or injured while in Pack Animals’ care, you authorize Pack Animals to obtain veterinary care at its discretion and agree to be responsible for all associated costs, including transportation. You release Pack Animals from any claim arising from such veterinary treatment decisions or services.
6. Express Waiver
You expressly waive all rights conferred by Section 1542 of the California Civil Code, or any similar law, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in their favor at the time of executing the release, which if known must have materially affected their settlement with the debtor.”
7. Indemnification
By executing this Waiver, becoming a Hub Member, or utilizing our facilities and services, you knowingly and voluntarily accept these risks and release and hold harmless Pack Animals and its affiliates from any claims or liabilities of any kind arising out of your participation or your dog’s participation. You further agree to indemnify and hold harmless Pack Animals, its employees, agents, and affiliates from any claims, damages, losses, or expenses, including attorneys’ fees, arising from your dog’s behavior, including but not limited to injury or damage to other animals, persons, or property. Pack Animals is not responsible for loss or damage to any personal property left with your dog, including collars, leashes, tags, or toys.
8. Miscellaneous
This Waiver is personal and non-assignable by you and constitutes the sole and entire agreement between Pack Animals and you with respect to the subject matter contained herein. It supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral. If any provision of this Waiver is held invalid or unenforceable, such invalidity shall not affect any other provision. This Waiver is binding on and benefits both parties and their respective successors and assigns.
All matters arising out of or relating to this Waiver are governed by the laws of the State of California. Any claim or cause of action may be brought only in the federal or state courts located in San Francisco, California, and you consent to the exclusive jurisdiction of such courts.
